Terms of Use
1. Acceptance of these terms
These Terms of Use govern your access to and use of the Kowopay website and marketplace (the “Service”), operated by Kowopay LLC. By creating an account, browsing listings or placing an order, you agree to be bound by these terms.
If you do not agree with any part of these terms, please do not use the Service.
2. Who can use Kowopay
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use Kowopay. By using the Service you confirm that the information you provide is accurate and that you have the legal capacity to enter into a binding agreement.
3. Your account
You are responsible for keeping your account credentials confidential and for all activity carried out under your account. Notify us immediately if you suspect unauthorised use. We may suspend or close accounts that breach these terms or that we reasonably believe present a risk to other members.
- Keep your contact and payment details accurate and current.
- Do not share, sell or transfer your account to another person.
- One person or business may not operate multiple accounts to evade limits or penalties.
4. The marketplace model
Kowopay is a marketplace. Records are listed, described, priced and shipped by independent third-party sellers. Kowopay is not the seller of those records and does not take ownership of them. The contract of sale for any record is formed directly between the buyer and the seller, on the terms set out in our Sales Terms.
5. Buying and selling
Buyers agree to pay for records they order and to provide accurate delivery details. Sellers agree to describe and grade every record honestly, to hold listed stock, and to dispatch within the handling time stated on the listing. Detailed buyer and seller obligations are set out in the Sales Terms.
6. Prohibited conduct
When using Kowopay you agree not to:
- List counterfeit, bootleg or misrepresented pressings.
- Post false, misleading or deliberately inaccurate condition grades.
- Circumvent the platform to complete or settle a transaction off-site.
- Upload unlawful, infringing or abusive content, or interfere with the Service's operation.
- Use automated systems to scrape, copy or overload the Service.
7. Content and intellectual property
The Kowopay name, logo, interface and original content are the property of Kowopay LLC and may not be reused without permission. Sellers grant Kowopay a licence to display the listing text and photographs they upload for the purpose of operating and promoting the Service.
8. Disclaimers
The Service is provided on an “as is” and “as available” basis. While we vet sellers and operate a buyer-protection programme, we do not warrant that every listing is error-free or that the Service will be uninterrupted. Records are second-hand collectible goods and natural variation in condition is expected.
9. Limitation of liability
To the fullest extent permitted by law, Kowopay LLC is not liable for indirect or consequential losses arising from your use of the Service. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.
10. Changes and termination
We may update these terms from time to time. Material changes will be announced on this page with a revised date. You may close your account at any time; we may suspend access where these terms are breached.
11. Governing law
These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Mandatory consumer-protection rules of your country of residence continue to apply.
